Terms and Conditions

Please read these Terms carefully. By checking the box at checkout or by purchasing any offer, you agree to these Terms and to any policies referenced here. These Terms apply to the following offers, each defined below:

    2. Shift Session 50-Minute Coaching Call
    3. Energy Leadership Index (ELI) Assessment & Debrief

If you purchase more than one offer, the offer‑specific section for each applies in addition to the General Terms.

 

General Terms

 

1) Who we are

These Terms are between Dana Zellers (the Company) and you (the Client). Services are provided virtually unless we agree otherwise in writing. For questions, contact dana@danazellers.com. Official communication is via email. Social media DMs are not monitored for client support.

 

2) Scope of services

Coaching is a collaborative, future‑focused service that supports clarity, effectiveness, relationships, and professional results. Coaching is not therapy, counseling, legal advice, tax advice, or medical care. You agree to seek appropriate professional help for those needs. Services do not include done-for-you deliverables.

 

3) Client responsibilities

You are responsible for your decisions, actions, implementation, and results. You agree to:

  • Show up on time and prepared
  • Participate safely and with full attention; sessions should not take place while driving or multitasking.
  • Communicate honestly and request support when you need it

4) Scheduling and time zones

All sessions are scheduled through the Company’s online calendar. Times are shown in the time zone stated on the calendar. If a platform issue prevents the session from starting, both parties will attempt to reconnect within 10 minutes. If reconnection is not possible, the session will be rescheduled.

 

5) Communications between sessions

Email support is included only where stated in the offer‑specific terms. When included, the Company will make every effort to respond within 24 business hours. Business hours are Monday through Friday, excluding U.S. federal holidays. Notification will be provided by the Company for any extended periods of unavailability.

 

6) Rescheduling and no‑shows

At least 24 hours’ notice is required to reschedule. Late arrivals reduce your session time. If you are more than 15 minutes late without notice, the session is treated as a no‑show and is forfeited.

 

7) Payments, billing, and taxes

You authorize the Company to charge your payment method for the price shown at checkout, including any applicable taxes. Prices may change for new purchases. For subscriptions, see the subscription terms in the offer‑specific section. Payment processing is handled by Stripe and follows their terms. You agree not to initiate a chargeback without first emailing the Company to resolve the issue.

    8) Refunds

    Unless an offer‑specific section states otherwise, all payments are non‑refundable. If you believe coaching is not working as desired, tell the Company promptly so we can adjust our approach.

     

    9) Confidentiality

    Information shared in coaching sessions is treated as confidential. The Company may disclose information if required by law, to protect rights or safety, or with your written permission. The Company may anonymously reference general topics or de‑identified wins for marketing or training. For credentialing, the Company may log Client name, contact info, and session dates.

     

    10) Intellectual property and materials

    Any materials you receive are licensed for your personal use only. You may not copy, distribute, re‑use, adapt, or share them without written permission. The Company’s names, trademarks, service marks, and program names may not be used without permission. Commercial use requires a separate license agreement. Unauthorized use may result in termination of access and invoicing for a license fee.

     

    11) Professional standards

    The Company commits to ethical, respectful conduct. If at any time the Company believes the relationship is not a fit, the Company may end services and will follow any refund terms stated for that offer.

      12) Technology and substitutions

      Platforms and tools may change. If an included feature is no longer available, the Company may substitute a similar feature of equal or greater value.

       

      13) Limitation of liability

      To the maximum extent permitted by law, the Company is not liable for indirect, incidental, consequential, special, exemplary, or punitive damages. The Company’s total liability for any claim is limited to the amount you paid for the offer during the three months before the claim arose.

       

      14) No guarantees

      Results vary. You understand that your outcomes depend on many factors, including your engagement, capacity, and environment. The Company does not promise any specific outcome, such as a promotion or raise.

       

      15) Governing law and venue

      These Terms are governed by the laws of the State of California without regard to conflict rules. You agree to the exclusive jurisdiction and venue of state or federal courts located in San Francisco, California.

        16) Changes to these Terms

        The Company may update these Terms at any time. The version in effect at the time of purchase applies to that purchase. For subscriptions, material changes will be communicated in advance and will apply starting with the next billing cycle.

         

        17) Changes to these Terms

        By checking the box and completing your purchase, you acknowledge that you have read and agree to these Terms and to the offer‑specific terms below.

         

        Offer Specific Terms

         

        A) Career Catalyst 1:1 Monthly Coaching

        What is included

        • Two 50‑minute one‑on‑one coaching sessions each month via Zoom
        • The initial booking link is provided after payment
        • Subsequent Zoom sessions to be scheduled as recurring appointments and then adjusted by either party with 24 hours’ notice (if Company reschedules to a time that the Client is unavailable, it is Client responsibility to reschedule via the link on the appointment); if either party will have extended unavailability, a discussion as to rescheduling and/or a pause of services is to be discussed
        • Optional resources and worksheets as appropriate
        • Email support for quick questions between sessions, with replies targeted within 24 business hours

        How it works

        • The subscription begins on the purchase date and bills monthly on the same calendar day.
        • Sessions must be used within the billing month and do not roll over.
        • You may cancel at any time. Cancellation is effective at the end of the current billing period. There are no partial‑month refunds.
        • If payment fails and is not updated within 7 days, access to sessions and support will pause until payment is current. Repeated failures may result in cancellation.
        • Rescheduling requires at least 24 hours’ notice. No-shows or late cancellations are forfeited.

        Coach discretion

        • If the Company determines the relationship is no longer a fit, the Company may cancel the subscription and will refund any unused portion of the current billing month on a pro-rated basis by session. Otherwise, cancellation is the Client’s responsibility via the Stripe system.

        B) Shift Session 50-Minute Coaching Call

        What is included

        • One 50‑minute one‑on‑one session via Zoom focused on a specific goal or challenge

        How it works

        • The booking link is provided after payment. The session must be scheduled within 60 days of purchase.
        • This offer does not include ongoing email support after the session unless otherwise stated on the checkout page.
        • Rescheduling requires at least 24 hours’ notice. No-shows or late cancellations are forfeited.

        C) Energy Leadership Index (ELI) Assessment & Debrief

        What is included

        • One Energy Leadership Index assessment delivered via email from a third-party service
        • An Energy Leadership PDF report
        • One 75‑minute breakdown session via Zoom

        How it works

        • The assessment link is provided following payment.
        • Once an assessment code is issued, the purchase is non‑refundable.
        • The debrief booking link is provided after the assessment is complete. 
        • You agree to complete the online assessment at least 3 business days before the Zoom breakdown session.
        • The debrief must be scheduled within 60 days of purchase unless we agree otherwise in writing.
        • Rescheduling requires at least 24 hours’ notice. No-shows or late cancellations are forfeited.

        Third‑party terms

        • The ELI assessment is delivered through a licensed third party. You agree to any additional terms required by that provider.
